NewsHedge helps professionals discover and explore financial news and market-related information through its web sites, applications, or web applications (each an “App” or “Web App”) available at https://newshedge.com (the “Site”) (the Web App, the Apps, the Site, collectively the “Service”) or through a NewsHedge affiliate.
This Master Terms of Use, Terms of Service or additional Terms (defined below), as such terms and policies may be updated from time to time (collectively, the “Terms”), governs your use of the NewsHedge Service.
By accessing our Apps, visiting the Site or otherwise accessing or using the Service, you agree that you are at least 13 years of age and that you have read, understood, and agree to be bound by these Terms. Please read them carefully.
You must comply with these master terms of use and any terms and conditions made available to you within the Services (“Additional Terms”). You are solely responsible for the use of the Service. By using the Service you acknowledge that your use of the Service is solely at your own risk. Use of the Site, Service, Web App or any other downloadable software provided by NewsHedge is subject to these master terms of use and any additional terms provided by NewsHedge.
In addition to these master terms of use, the following additional terms apply to your use of the Service. By using the Service, you agree to be bound by these additional terms as applicable, which are incorporated herein by reference (collectively the “Additional Terms”):
Privacy Policies - describes NewsHedge policies with respect to the use, collection, and disclosure of personal information from you or your organization.
Disclaimer - describes NewsHedge’s position with regards to information being obtained, formulated, disseminated, or reported and obtained.
Account Billing Policies – outlines NewsHedge policies with respect to billing.
You may not copy, reproduce, recompile, disassemble, decompile, distribute, reverse engineer, publish, broadcast, rebroadcast, display, perform, modify, upload to, create derivative works from, transmit or in any way exploit all or any part of the Site or Services, except as expressly provided in these “Terms”.
The contents and audio broadcastings may not be recirculated, redistributed or published by you without prior written consent from NewsHedge. You may not offer any part of the Site or Service for sale, trade, exploit or distribute it over any other medium to be replicated, multiplied or amplified for any use including but not limited to television or radio broadcastings, a computer network or hyperlink framing on the internet without prior written consent from NewsHedge.
You may not use the Site or Service for any comparative or competitive research purposes;
Remove, circumvent, disable, damage or otherwise interfere with any security-related features of the Site or Service, or features that enforce limitations on the use of the Site or Service or any content therein;
Use any manual or automated means to extract and/or compile content from the Site or Service for any commercial purpose or otherwise;
Interfere with or disrupt the Site or Service, networks or servers connected to the Site or Service, or violate the regulations, policies or procedures of such networks or servers;
Use the Site or Service in any manner whatsoever that could lead to a violation of any security, federal, state or local laws, rules or regulations.
The Site and Service is owned and operated by NewsHedge. The software, content, visual interfaces, interactive features, information, visual data, trademarks, logos, graphics, design, compilation, computer code, products, software, services, content, and all other elements of the Service (“NewsHedge Materials” or “Content”), are protected by copyright, trade dress, trade secrets, patent, trademark or other proprietary rights and laws of the United States and other jurisdictions, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. All NewsHedge Materials, including intellectual property rights therein and thereto, are the property of NewsHedge or its subsidiaries or affiliated companies and/or third-party licensors. You may not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of NewsHedge Materials or Content. NewsHedge reserves all rights not expressly granted in these Terms. You shall not acquire any right, title or interest to the NewsHedge Materials or Content, whether by implication, estoppel, or otherwise, except for the limited rights set forth in these Terms. However, you may print a single copy of the Content for your own personal use, provided that you maintain any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices.
The trademarks, service marks, trade names and logos used and displayed on the NewsHedge Site and Services (the "Marks") are registered and unregistered trademarks of ours. All page headers, custom graphics, button icons, and scripts are Marks of NewsHedge and may not be copied, imitated or used, in whole or in part, in connection with any product or service that is not authorized by NewsHedge, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits us. The Marks are and shall remain our sole property. Nothing in these terms shall be construed as granting, by implication, estoppel or otherwise, any license, ownership right, or right to use any Marks. The misuse of the Marks or any other Content is strictly prohibited.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the U.S. Digital Millennium Copyright Act.

All audio text-to-speech broadcasts, audio alerts, sounds, text, graphics, animation, videos, music, software, code and other material on the Site and Service are subject to the copyrights and other intellectual property rights of NewsHedge, its affiliated companies and its licensors. NewsHedge owns the copyrights in the selection, coordination and arrangement of the materials, information and data on this Site and Service.
The methods created by NewsHedge are protected by patents and pending patents (patent-pending) in the U.S. and elsewhere.
Trademarks displayed on this Site and Service are subject to U.S. trademark rights of NewsHedge and its partners or are used within agreement in the U.S. by NewsHedge and its partners. The unauthorized use of any trademark displayed on this Site and Service is strictly prohibited without prior written consent from NewsHedge.
NewsHedge does not allow use of the Site or Service for any illegal, abusive purposes, or in any manner that interferes with or interrupts the proper functioning of the Service, or through the use of any bot, crawler, spider, or other automated process. NewsHedge also does not allow use of the Site or Service to be recorded or re-broadcasted without the direct permission and written consent of it’s directors. NewsHedge reserves the right to restrict or terminate your right to use particular features of the Site or Service if NewsHedge determines, in its sole discretion, that your use violates these Terms or any other applicable Additional Terms.
The 21 day free trial entitles you to try the full Service on these terms and conditions. You must register an active email to take advantage of a free trial. The free trial period commences on the day that the Service is first accessed and concludes 21 days after that date. Your commencement date is when you first log in. If no payment information is on file prior to the end of your trial, your trial will end, or cancel automatically. Trial extension credits obtained from referrals (verified emails) will be capped at a total of 20 weeks. Extended free trials are subject to the same terms and conditions as 21 day free trials. NewsHedge reserves the right, in its absolute discretion, to withdraw or to modify free trial offers and/or trial extension credits obtained from referrals at any time without prior notice and with no liability. By registering to participate in a free trial you expressly consent to have your email added to our database to receive Newshedge updates, offers, reminders, notices and other appropriate material from us.
These Terms will remain in effect until terminated. These Terms, and your rights and licenses hereunder, will terminate immediately upon your breach of the Terms. You may terminate these Terms by canceling your account and subscription with NewsHedge. NewsHedge may terminate the Service, disable any App, and/or these Terms, or limit or terminate your access to the Site or Services at any time for any reason or no reason at all. NewsHedge reserves the right to dictate if any refunds will be granted in connection with any termination of the Service. You agree that the termination of your account is your sole remedy for any dissatisfaction with the Service.
NewsHedge reserves the right, within its sole discretion, to remove, add, modify, or alter features of the Site and Service at any time for any reason without liability to you. NewsHedge may change, modify, add, or remove portions of these Terms (including the Additional Terms) at any time by making such modified terms available to you on the NewsHedge website or through the NewsHedge Service.
THE SERVICE IS PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEWSHEDGE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUALITY, AND NONINFRINGEMENT. NEWSHEDGE EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND WITH RESPECT TO THE SITE AND SERVICE, INCLUDING WITH RESPECT TO THE ACCURACY OR FUNCTIONALITY OF THE SERVICE, THE ACCURACY, VALIDITY, OR COMPLETENESS OF ANY INFORMATION AVAILABLE THROUGH THE SERVICE.
In no event shall NewsHedge be liable for direct, indirect, or incidental damages resulting from the use of the information. NewsHedge shall be indemnified and held harmless from any actions, claims, proceedings, or liabilities with respect to the information and its use.
NewsHedge is not an investment advisor, broker or dealer and therefore does not participate in the offer, sale or distribution of securities, nor does it provide any investment advice or trading recommendations.
You agree to indemnify, defend and hold NewsHedge and its affiliates, members, partners, officers, directors, managers, employees, agents, suppliers, technology vendors, successors and customers harmless from and against any and all liability and costs, including reasonable attorneys’ fees incurred by such parties, in connection with or arising out of your use or misuse of the Site or Service, your violation of the Terms, any applicable law or regulation, or the rights of any third parties related to the use of the Site or Service.
You hereby represent and warrant that the information you or your organization provide upon registration will be true, accurate, current, and complete. You also hereby represent and warrant that you will keep this information up-to-date at all times.
To become a registered user of a NewsHedge Account, you will establish a user name (“Username”) and a password (“Password”). You are solely responsible for the confidentiality and use of your Username and Password, as well as for any use, misuse or communications through the Services using them. You may not share your personal account information with, or allow access to your account by any third party. Please preserve the confidentiality of your account information at all times. If you believe your account information has been compromised, you agree to immediately change your password and notify NewsHedge by e-mail at privacy@newshedge.com. We reserve the right to delete or change your Password, Sign-in Name or Unique Identifier at any time and for any reason.
If you are using our Services on behalf of a company or other organization, that company or other organization will be bound by these terms, and you hereby warrant and represent that you are authorized to accept and agree to these terms on behalf of such company or other organization
We may modify these terms or any additional terms that apply to the NewsHedge Site and Services at any time. You should review these terms regularly. We'll post notice of modifications to these terms on this page and post applicable notices within the Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions within the Services or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms of use with regards to the Site or Service, your sole and exclusive remedy is to discontinue your use of that Service. If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict. These terms control the relationship between NewsHedge and you. They do not create any third party beneficiary rights. If you do not comply with these terms, and we don't take action right away, this doesn't mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms. The laws of the State of Illinois, without regard to its conflict of laws rules, will apply to these terms any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts located in Chicago, Illinois, and you and NewsHedge consent to personal jurisdiction in those courts. A printed version of these terms shall be admissible in judicial or administrative proceedings based on or relating to these terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. These terms, together with any Additional Terms, constitute the entire agreement between you and NewsHedge with respect to the Services, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and NewsHedge with respect to the Services.
